The following terms and conditions of service govern the interactions between Exam Consult Inc. (the provider) and Exam Consult Inc. customers regarding the provision of Exam Consult’s services and products. These termsbecome effective immediately once a user registers as a client with the provider and are liable to modifications at the discretion of the provider. The revised terms will become effective thirty (30) days after the modifications have been posted.
If the customer follows the conditions and terms that have been established, the provider agrees to provide the customer with an account for its online testing services on a private server. In the case of a planned modification in the provider’s network or infrastructure, the provider agrees to give reasonable notice to the customer of the changes. The customer agrees to provide up-to-date and accurate personal identification information when they register for an account with the provider. In the case of a security breach or unauthorized use of an account, the customer agrees to notify the provider in a timely fashion. The provider will not be held accountable for any loss or damage that results from lack of up-to-date, accurate information orfrom negligence with regard to account security.
The terms that govern the manner in which products and services are delivered by the provider to the customer is exclusively between the customer and the provider. These terms do not apply to any third party beneficiaries unless explicitly stated by the provider in writing.
The provider holds the privacy and security interests of the customer as a top priority and will take all measures necessary to guard customers’ content from illegal usage and unauthorized access.
The provider’s delivery of its services and products is dependent on external factors such as servers, networks, and third-party tools. In the case that an unanticipated event occurs with regard to any of these circumstantial elements, the provider will do its best to resolve the issue but may be constrained by the factors previously mentioned.
In the case that the software malfunctions or gives the user an error message, the provider will attempt to solve the problem as quickly as possible given the time constraints that are often involved in test delivery and management.
Once the institution purchased subscription, full access of software and services will be granted immediately.
The customer agrees to a one-year subscription term for the provider’s testing services which starts on the date that the customer order is placed. When the subscription period draws near to the renewal date, the provider will notify the customer well in advance of this date. Customers will have a week (seven days) to cancel their subscriptions by sending the provider an email expressing their wishes to terminate their account.
The provider is under no obligation to refund any payments made in advance by the customer.
If examconsult does not fulfill the requirement, set forth by your organization, we will issue full refund within 60 days of period.
The customer is held responsible for the cancellation of their account as well as storing and deleting their personal information. Customers can cancel their accounts at any time through an option in the administrator area. When this occurs, the account is permanently disabled and the information contained there cannot be recuperated.
The Terms of Use are interpreted and followed in accordance with the laws of the United States of America. All legal disputes are to be handled by the local court corresponding to the physical address of the service provider (see following point).
